The Contract Between Us
Any contract for purchases made through the website will be with Westmount Living. We must receive payment of the whole of the price for the goods that you order before your order can be accepted, and the contract formed.
Once payment has been received we will confirm that your order has been received by sending an email to you at the email address you provide in your registration form. The shipment email will include your name, the order number and the total price. Our acceptance of your order brings into existence a legally binding contract between us on these terms. Any term sought to be imposed by you in your order will not form part of the contract.
We are entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods appearing on our website. If an error or inaccuracy is discovered with regards to the advertised price of the goods that you have ordered, we will contact you as soon as possible by e-mail or phone. This will be to inform you of the correct price of the goods, and to ask you if you wish to continue with the order at the amended price, or to cancel the order altogether.

These terms and conditions and all transactions relating to this website are governed by English law and are subject to the non–exclusive jurisdiction of the English courts. We do not accept amendments to these terms and conditions.

Trade Descriptions Act
Every care has been taken to ensure that the descriptions and specifications of our products on this web site are correct. However, whilst the colour reproduction is a close representation, a colour variation in the actual goods may occur.
Payment Details
We accept payment by most Credit and Debit cards including Visa, MasterCard, American Express, Switch, Maestro and Delta. All product prices and delivery charges are shown in UK pounds sterling. Your payment card company will perform any currency conversion.
Upon receiving your order, we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds in order to fulfil the transaction. No payment is debited from your card during this pre-authorisation check. Your card will only be charged upon dispatch of the items in your order. Your card will not be debited for items in your order which have not been dispatched, apart from magazine subscriptions, which, due to their nature are invoiced before the magazine is dispatched.
Discount Codes
1. Account discount codes - Discount codes may from time to time be offered to account holders; such codes may only be applied to purchases made through the account in respect of which the discount code was offered and registered.
2. Promotional discount codes - We may from time to time offer promotional discount codes which may apply in respect of any, or certain specified, purchases made though this Website.
Availability of Goods You Order
If we have insufficient stock to deliver the goods ordered by you, we will notify you as soon as possible and any sum debited by us will be re-credited to your account and we will notify you by email at the address given by you in your order form. The refund will be made as soon as possible and in any event within 30 days of your order. We are not be obliged to offer any additional compensation for disappointment suffered. Please note: we endeavour to bring our customers the best value we can by running special offers, but please remember stocks are limited at the special offer price, and subject to availability. We update our website as quickly as we can to minimise disappointment. The process of updating the website when goods have sold out at promotional price can take a few hours to update.
Price Promise
We believe that all of our products offers excellent value for money and that our prices are among the most competitive either online or through retail outlets. We regularly check our prices to ensure that our products continue to represent exceptional value for money. If you find a product with our 'Price Promise' label for sale in Westmount Living cheaper anywhere else, we will match the lower price or in some cases beat the lower price. This applies to items for sale in any UK retailer - in stores, catalogues and online (excluding auction and market sites) for an identical product where the item is:
1. In stock and available for dispatch,
2. Listed as 'New' (excludes used, refurbished or returned products),
3. Price is inclusive of VAT and all associated delivery and handling charges,
4. Not on sale / clearance,
5. Sold by a genuine UK VAT registered business with a legitimate certificate of registration.
We can only match or beat prices provided prior to sale. Please contact us with sufficient infomation so that we can verify the price, before placing your order with us.
Please note that we reserve the right not to uphold the price promise if doing so would result in Westmount Online Ltd making a transactional loss. The price promise can not be applied retrospectively to orders already placed.
Free UK Mainland Delivery
We offer free delivery to UK mainland only on selected products/ ranges with in our store. If free delivery is applicable this will be stated beside or near to the Buy button on the product page. Free mainland delivery excludes the following zones; Northern Ireland, Scottish Highlands & Islands, Offshore Islands & Channel Islands including the Isle of Wight. Please contact us providing your full postal address and the items you are interested in, to request an accurate carriage quote.
Postage
You will only pay one delivery charge per order, which will be the highest depending on the contents of your order and your chosen delivery service. When you have added items to your shopping basket, the standard delivery charge for those products will be automatically applied to your order.
Force Majeure
We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.
Returns
If you need to return a product purchased from us then you have 7 days to do so from receipt of goods. The returned goods must be in a resalable state and any goods or accessories that accompany the returned product must also come back to us. Please contact us by email to request a Returns Reference Number (RRN) and returns address. Goods can not be exchanged or refunded with out an RRN.
The goods should also be returned with their original box, packing and accessories.
If the return is due to faulty parts then we will offer a full refund or replacement provided we are aware of this within 7 working days.
Any refund, which is due to a fault or other defect, will include a refund of the applicable delivery charge. Please retain proof of postage and receipt of cost. Delivery costs can only be refunded upon proof of receipt.
This returns policy does not affect your legal rights.
Damaged or Missing Goods
Must be reported within 48 hours of receipt. Ensure the goods are thoroughly inspected before accepting and signing for your consignment. We recommend that you sign for your goods as damaged in the event you need to make a claim. A report of damage or missing items must be made in writing and sent to sales@westmount-living.co.uk within 48 hours.
Cancellation of Orders
You are able to cancel your order prior to shipping with no cost penalty being incurred and full credit of your account if monies have already been taken. You can cancel an order by following the links on our website, or by email.
We endeavour to process all orders taken before 12pm the same day for delivery next day* - subject to availability, size and weight. *depending on item, delivery may take 1-4 days.
Changes to This Agreement
We reserve the right to make changes to our site, policies, and these terms and conditions at any time. If any of these conditions shall be deemed invalid, void, or for any reason unforeseen, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
